Ordinance 658 2025 UPOC

                                                 ORDINANCE NO.  658

 

            AN ORDINANCE AMENDING SECTION X-1 OF CHAPTER X OF THE CODE OF THE CITY OF BUHLER, KANSAS, BY ADOPTING THE UNIFORM PUBLIC OFFENSE CODE FOR KANSAS CITIES, 2025 EDITION, PROVIDING FOR CRIMINAL OFFENSES, PENALTIES AND REPEALING ANY ORDINANCE IN CONFLICT THEREWITH.

 

            BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BUHLER, KANSAS:

 

            SECTION 1.  That Section X-1 of “the Code of the City of Buhler, Kansas,” is hereby amended to read as follows:

  1. There is hereby incorporated by reference under the provisions of K.S.A. 12-3009 through 12-3012, including any amendments thereto, and K.S.A. 12-3301 and 12-3302, for the purpose of prohibiting certain crimes within the city, that certain standard ordinance known as the “Uniform Public Offense Code for Kansas Cities,” 2025 Edition, prepared and published by the League of Kansas Municipalities, Topeka, Kansas, and any additions thereto expressly hereinafter stayed, and as the same has been amended by the Kansas Legislature by statute, save and except such articles, chapters, sections, parts or portions as are expressly hereinafter omitted, deleted, modified or changed. One copy of said Uniform Public Offense Code shall be marked or stamped “Official Copy as adopted by Ordinance No. 658 “, with all sections or portions thereof intended to be omitted or changed clearly marked to show any such omission or change and to which shall be attached to a copy of the ordinance, and filed with the City Clerk to be opened to inspection and available to the public at all reasonable hours.

           

            SECTION 2. That Section 5.6 (c) of the Uniform Public Offense Code for Kansas cities, 2025 Edition, is hereby amended to read as follows:

                       

            “(c) Violation of this section shall be an ordinance cigarette or tobacco infraction for        which the fine shall be $75 on the first offense, $200 on the second offense, and        $500 for           the third offense. In addition, the judge may require the juvenile to appear in court with a parent or legal guardian. (K.S.A. 79-3321;3322)

 

            SECTION 3.  That Ordinance No. 649 shall be and is hereby repealed.

 

            SECTION 4.  That this ordinance shall be in effect from and after its passage and publication once in the official city newspaper.
